AGREEMENT TO TERMS
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Rakefire LLC (“Company,” “we,” “us,” or “our”), concerning your access to and use of the Stoked web application and any other related media forms (collectively, the “Site”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms or policies may be posted on the Site from time to time and are expressly incorporated by reference. We reserve the right, in our sole discretion, to make modifications to these Terms of Use at any time. We will update the “Last Updated” date, and continued use of the Site after such updates constitutes acceptance of the revised terms.

INTELLECTUAL PROPERTY RIGHTS
Unless otherwise stated, all content, source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics, trademarks, service marks, and logos (collectively, the “Content”) are owned or licensed by Rakefire LLC and are protected under copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not copy, reproduce, republish, sell, or otherwise exploit the Content without our prior written permission.
USER REPRESENTATIONS
By using the Site, you represent and warrant that:
- Any registration information you submit is accurate and up-to-date.
- You have the legal capacity to comply with these Terms.
- You are not under the age of 18.
- If you are a minor, you have parental consent to use the Site.
- You will not use automated means (bots, scripts, etc.) to access the Site.
- You will not use the Site for unlawful purposes.
- Your use of the Site does not violate any applicable laws.
If you provide false or outdated information, we reserve the right to suspend or terminate your account.
USER REGISTRATION
You may be required to register with the Site. You are responsible for keeping your account credentials confidential and will be held liable for any unauthorized access or actions taken through your account.
FEES AND PAYMENT
We accept the following payment methods:
- Visa, Mastercard, American Express, Discover
- Approved Check Payments
By purchasing services, you agree to:
- Provide current, complete, and accurate payment details.
- Update billing information as necessary.
- Authorize us to charge your payment method for all applicable fees.
- Acknowledge that subscriptions may auto-renew until canceled.
- Accept that prices may be updated from time to time.
We reserve the right to correct pricing errors, even after payment has been processed.
CANCELLATION & REFUND POLICY
How to Cancel:
- You may cancel your subscription anytime directly within the Stoked web application.
- If you need assistance, you may contact support by email at [email protected] or call (740) 561-1361. Please note that cancellation requests made via email or phone may not be honored unless submitted at least 5 business days before the renewal date.
- Cancellations take effect at the end of the current billing period.
- If you cancel mid-term, you will continue to have access to the service for the remainder of the paid-up term.
- No refunds will be issued for unused portions unless required by law.
AUTOMATIC RENEWAL & NOTIFICATION
- Your subscription will automatically renew unless canceled before the renewal date.
- You will receive an email notification at least 10 business days before renewal.
- You are responsible for managing your subscription and ensuring cancellations are completed before renewal.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Rakefire LLC is not liable for indirect, incidental, or consequential damages arising from your use of the Site.
- Our total liability will not exceed the amount you have paid in the last 12 months.
- We do not guarantee uninterrupted, error-free service.
Some jurisdictions do not allow certain liability exclusions, so these limitations may not apply to you.
USER-GENERATED CONTENT
Rakefire LLC will not sell user-generated content without consent but may use uploaded text or photos for marketing purposes for the brands we represent or for the product.
DISPUTE RESOLUTION
Informal Negotiation
Before initiating arbitration, both parties agree to attempt to resolve disputes informally for at least 30 days.
Binding Arbitration
If a resolution is not reached, disputes shall be settled through binding arbitration under the rules of the American Arbitration Association (AAA). Arbitration will take place in Athens County, Ohio, United States.
Small Claims Exception: You may bring claims in small claims court if the claim exceeds $5,000, though binding arbitration is preferred by both parties.
SERVICE AVAILABILITY & TERMINATION
- If Rakefire LLC decides to terminate the service, customers will receive at least 3 months’ notice before shutdown.
- Customers will be able to access and export their data prior to termination.

FINAL REMARKS
These Terms of Use constitute the entire agreement between you and Rakefire LLC regarding the use of the Stoked service, except as supplemented by our Privacy Policy available athttps://get.stokedhq.com/privacy, which is incorporated by reference.
By continuing to use Stoked, you acknowledge and agree to these Terms.
